National Guard Leave and Re-Employment Rights

On June 23, 2018, Alaska Governor Bill Walker signed legislation (H.B. 3) extending leave to Alaska residents who are called to action as members of the national guard of another state. Upon return from a period of active state service, an employee is entitled to reinstatement to his or her former or comparable position, at the former pay, seniority, and benefit level.

The law added an exception where an employee is not entitled to such re-employment if either of the following apply:

  • The employer’s circumstances have changed, making employment impossible or unreasonable.
  • Employment would impose an undue hardship on the employer.

The law is effective September 21, 2018.
