Minimum Wage Increases

On July 1, 2018, Delaware Governor John Carney signed legislation (S.B. 170) increasing the state’s minimum wage as follows:

  • $8.75 per hour effective October 1, 2018.
  • $9.25 per hour effective October 1, 2019.

Health Insurance Offers

On June 30, 2018, Delaware Governor John Carney signed legislation (S.B. 139) requiring health insurance offered in Delaware provide coverage for fertility care services, including in vitro fertilization procedures, for individuals who suffer from a disease or condition that results in the inability to procreate or to carry a pregnancy to a live birth.

The law became effective June 30, 2018.

Labor Relations

On June 30, 2018, Delaware Governor John Carney signed legislation (S.B. 165) permitting private sector labor organizations and employers to execute and apply an agreement requiring membership in a labor organization as a condition of employment, to the full extent allowed by federal law. The law also declared it to be state policy to encourage a harmonious and cooperative relationship between employers and their employees by allowing private sector labor organizations and employers to enter into union security agreements to the full extent allowed under the National Labor Relations Act, 29 U.S.C. § 164(b).

The law became effective June 30, 2018.
