July 2, 2018Noncompete Agreements and Rebuttable Presumptions
On March 28, 2018, Idaho Governor Butch Otter signed legislation (S.B. 1287) removing the rebuttable presumption that irreparable harm occurs when a key employee or independent contractor is in breach of a noncompete agreement or covenant.
The law is effective July 1, 2018.

Franchises
On March 20, 2018, Idaho Governor Butch Otter signed legislation (H.B. 527) regarding franchise agreements and employment status. Under the law, neither a franchisee nor its employee is an employee of the franchisor for any purpose, unless:
- The franchisee or its employee is specifically described as an employee of the franchisor in the franchise agreement; or
- The franchisor is found or has been found by a court, or another tribunal, to have exercised a type or degree of control over the franchisee or its employee that is not customarily exercised by a franchisor.
The law is effective July 1, 2018.
