November 19, 2018Veterans’ Right to Participate and Take Leave
On August 9, 2018, Massachusetts Governor Charlie Baker signed legislation (S.B. 2632) requiring employers to allow eligible employees to participate in Memorial Day events and take leave to observe Veterans’ Day. Specifically, the law states the following:
- An employee who is a veteran, or a member of a department of war, and who wants to participate in a Memorial Day exercise, parade, or service in the employee’s community of residence must be allowed and granted a leave of absence of sufficient time to so participate. The leave of absence may be with or without pay, at the employer’s discretion.
- An employee who is a veteran, or is a member of a department of war veterans, must be granted time off to observe Veterans Day. This time off may be with or without pay, at the employer’s discretion.
However, these provisions do not apply to employees whose services are essential and critical to public health or safety and determined to be essential to the employer or the employer’s property.
The law is effective November 7, 2018.
