Payment of Wages

On March 19, 2018, Utah Governor Gary Herbert signed legislation (S.B. 212) addressing the payment of unpaid wages to a commission-based sales agent after the employer separates the sales agent from its payroll.

The law is effective May 8, 2018.

Workers’ Compensation Claim Protections

On March 19, 2018, Utah Governor Gary Herbert signed legislation (H.B. 288) making it unlawful for an employer to interfere with an employee’s ability to seek workers’ compensation benefits or to retaliate against an employee for seeking such benefits. Under the law, employers in violation of these protections will be penalized by a fine of up to $5,000 for each violation.

The law is effective May 8, 2018.

Workers’ Compensation Penalty Amendments

On March 16, 2018, Utah Governor Gary Herbert signed legislation (S.B. 75) amending the noncompliance penalties under the Utah Workers’ Compensation Act. The law also provides circumstances where the Utah Division of Industrial Accidents may waive or reduce a penalty against an employer for conducting business without securing workers’ compensation benefits for its employees.

The law is effective May 8, 2018.
