On May 28, 2018, Vermont Governor Phil Scott signed legislation (H.B. 707) relating to the prevention of sexual harassment. The bill:

  • Details an employer’s obligation to ensure working relationships are free from sexual harassment.
  • Requires that employers develop a written policy prohibiting sexual harassment in the workplace along with prevention training upon hire.
  • Encourages annual training, and additional training for supervisors and managers.
  • Prohibits employment agreements that prevent an employee from disclosing sexual harassment, waive an employee’s rights or remedies to a claim of sexual harassment, or settle a sexual harassment claim by prohibiting the employee from working for the employer or its affiliate of the employer.
  • Provides additional protections against employment agreements that infringe on protections against disclosure of sexual harassment, and requires the attorney general be notified of any settlement.

The law is effective July 1, 2018.
