Delaware Employment Law Update – October 2018

Minimum Wage Increase and Updated Poster

On September 28, 2018, the Delaware Department of Labor released an updated labor law poster covering:

• Payment of wages.
• Minimum wage, with the following increases:
  • Regular Rate:
    • Effective January 1, 2019, the regular rate increases to $8.75 per hour.
    • Effective October 1, 2019, the regular rate increases to $9.25 per hour.
  • Youth Rate (ages 14 – 17) and Training Rate (adults during first 90 days of employment):
    • Effective January 1, 2019, the rate increases to $8.25 per hour.
    • Effective October 1, 2019, the rate increases to $8.75 per hour.
• Breaks.
• Discrimination, with additional information about sexual harassment, disability, and pregnancy discrimination.
• Child labor.
• Workers’ compensation.

The updated material in the poster is in red font. Employers are required by law to display this official poster in a place accessible to employees and where they regularly pass.
