Illinois Employee Misclassification Referral System Act and Online Reporting
On September 22, 2017, Illinois Governor Bruce Rauner signed legislation (S.B. 1978) enacting the Illinois Employee Misclassification Referral System Act. The act requires the Illinois Department of Labor to create an online employee misclassification referral system on its website where misclassification complaints may be made to the Department of Employment Security, the Illinois Workers’ Compensation Commission, the Department of Revenue, and the Department of Labor, as applicable, via one form. Anonymous and third-party complaints will not be accepted.
The law is effective July 1, 2018.

Illinois Day and Temporary Labor Services Act Updated
On September 22, 2017, Illinois Governor Bruce Rauner signed legislation (H.B. 690) amending the Illinois Day and Temporary Labor Services Act regarding all the following:
- Employee notice requirements.
- Exemptions of records from the Illinois Freedom of Information Act.
- Permanent employee placement.
- Prohibited deductions for consumer reports, any criminal background check of any kind, or any drug test of any kind.
- Registration provisions.
- Transportation requirements to and from the worksite.
The law is effective July 1, 2018.
