May 21, 2018Minneapolis Paid Sick and Safe Time — Court Rules Ordinance Applicable to Resident Employers Only
In a lawsuit brought against the City of Minneapolis in the case of Minnesota Chamber of Commerce et al v. City of Minneapolis, Court File No. 27-cv-16-15051, the Hennepin County District Court issued a temporary injunction prohibiting the City of Minneapolis from enforcing the Sick and Safe Time Ordinance against any employer resident outside the geographic boundaries of the city.
On May 9, 2018, the court upheld the ordinance; however, according to the ruling the ordinance is only applicable to employers within the city’s limits and cannot be enforced against nonresident employers (employers without a physical presence in the city). It is likely that this decision will be appealed, but at this time the ordinance is effective and employers within city limits must comply with it.
