May 7, 2018Allegations of Sexual Assault or Harassment and Nondisclosure Agreements
On April 25, 2018, Arizona Governor Doug Ducey signed legislation (H.B. 2020) regulating the terms of nondisclosure agreements. In addition to other protections, the law prohibits terms in nondisclosure agreements that prevent parties from:
- Responding to a peace officer’s or a prosecutor’s inquiry regarding allegations of sexual assault or sexual harassment.
- Making a statement not initiated by that party in a criminal proceeding regarding allegations of sexual assault or sexual harassment.
The law is effective August 5, 2018.
