On July 11, 2018, Delaware Governor John Carney signed legislation (H.B. 409) establishing the Delaware Workplace Adjustment and Retraining Notification Act (DE WARN Act). The law directs employers with 100 or more employees (excluding part-time employees), or 100 or more employees that work in the aggregate at least 2,000 hours per week, to provide at least 60 days’ advance notice to the Delaware Division of Employment and Training (division) of mass layoffs, plant closings, or relocation. It also provides dislocated workers the Rapid Response services and benefits that are due to them through the division to assist in returning them to work as quickly as possible.
The law is effective January 7, 2019.
